This bill will restore the benefits of a certain group of Vietnam Veterans who had those benefits illegally taken away by the Department of Veterans Affairs just because they were Blue Water Navy Vietnam Veterans. Senator Kirsten Gillibrand of New York, introduced S1939 the Agent Orange Equity Act of 2009 in the Senate on 10-27-2009. The bill will, when enacted, restore presumptive eligibility for exposure to herbicides to Veterans of the Vietnam War who served in the Blue Water Navy, the Blue Sky Air Force, and those who served in Thailand, Laos and Cambodia, all of whom were included in the original Agent Orange Act of 1991, but were later removed by the Department of Veterans Affairs.

First get a list of your States Senators and Representatives use the Links Page on this Site and find [Where to contact your Congressman or Senator - Or Click Here] use the [Find Who Represents you in Congress] option on the left side. This will provide search options. Select your State from the Drop Down Box. Then go to the bottom of the form and select the [Submit It] button. This site will then provide you with up to date contact information for your state's Senators and Representatives.

If you send a letter by US Mail it will take 3-6 weeks to reach a Senator or Representative. But if you FAX a letter they will receive it immediately without the security delay. Might I suggest NOT using the Email option because your Email may Not get the attention a letter or FAX would get. I have recently FAXed letters to all my Senators & Reps for the state of Massachusetts where we have 2 Senators and 10 Representatives and have already received replies by mail and phone. If you are not sure what to write about, go to the Links below and click on [Sample Letters for HR2254 Support] for some letter examples you could use in your support for HR2254 and S1939. Use them as they are. Make changes if you like. And keep your letter to a single page if possible. But most importantly get a letter out to Support for HR2254 and S1939 to YOUR States Senators & Representative NOW!

Also, while your here you could also fill in your name on the Online Petition on the Action Required Page. This Petition is separate from your letter requesting your Senator to Co-Sponsor S1939 on your behalf. This petition will be send to the Senate to try to open their eyes to how much support there is for correcting the egregious error the DVA made in their mandate of "boots on the ground" something not intended in the original Agent Orange Act of 1991. Your support is appriciated.

To amend title 38, United States Code, to clarify presumptions relating to the exposure of certain veterans who served in the vicinity of the Republic of Vietnam.

    Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

    This Act may be cited as the `Agent Orange Equity Act of 2009'.

SEC. 2. CLARIFICATION OF PRESUMPTIONS OF EXPOSURE FOR VETERANS WHO SERVED IN THE VICINITY OF THE REPUBLIC OF VIETNAM.

    (a) Clarification- Section 1116 of title 38, United States Code, is amended--

      (1) in subsections (a)(1) and (f), by striking `a veteran who, during active military, naval, or air service, served in the Republic of Vietnam during the period beginning on January 9, 1962, and ending on May 7, 1975' and inserting `a veteran described in subsection (g)'; and

      (2) by adding at the end the following new subsection:

    `(g) A veteran described in this subsection is a veteran who--

      `(1) during active military, naval, or air service--

        `(A) served in the Republic of Vietnam (including the inland waterways, ports, and harbors of such Republic, the waters offshore of such Republic, and the airspace above such Republic) during the period beginning on January 9, 1962, and ending on May 7, 1975; or

        `(B) served in Johnston Island during the period beginning on April 1, 1972, and ending on September 30, 1977; or

      `(2) received the Vietnam Service Medal or the Vietnam Campaign Medal.'.

    (b) Effective Date- The amendments made by subsection (a) shall take effect as of September 25, 1985.
